# Terms of service

Effective date: 25 October 2026

These Terms are a contract between Kitiquette ("we", "us") and the business that installs or subscribes to Kitiquette (the "Customer", "you"). By installing the App or paying for a subscription, you agree to these Terms on behalf of your business. If you do not agree, do not install or use the App.

## 1. The service

Kitiquette (the "App") is a HubSpot app that lets your team configure products under rules, apply capped discounts, and add the result to HubSpot deals as line items. It works with HubSpot Sales Hub Starter, Professional and Enterprise. The App runs inside your HubSpot account and on our server. It does not create quotes, contracts or invoices.

## 2. Accounts and installation

A super admin of your HubSpot account installs the App and approves the access it requests. You are responsible for who in your HubSpot account can use the App and for keeping your HubSpot account secure.

## 3. Subscriptions, trial and fees

- Plans and prices are listed at [https://www.kitiquette.com/pricing](https://www.kitiquette.com/pricing?hsLang=en). Fees are per HubSpot account, billed monthly or annually in advance.
- Each plan covers a number of reps; there is no limit on products. A rep is anyone in your HubSpot account who adds a build to a cart or deal with the App in a calendar month. We count reps to check plan limits (see our [Privacy policy](https://www.kitiquette.com/privacy?hsLang=en)). If you exceed your plan, we will ask you to move to a larger plan; more than 50 reps needs a custom agreement.
- A free trial of 30 days may be offered. At the end of the trial, continued use requires a paid plan.
- Payment is processed by Stripe. Fees exclude taxes, which you pay unless you provide a valid exemption.
- If a payment is more than 14 days overdue, we may suspend the App for your account after notice. We restore it promptly once payment is made.
- We may change prices with at least 30 days' notice, effective from your next billing period.

## 4. Your data

You own the data in your HubSpot account. You give us permission to process it only to provide, secure and support the App. Our [Data Processing Agreement](https://www.kitiquette.com/dpa?hsLang=en) forms part of these Terms and applies whenever we process personal data on your behalf. Our [Privacy policy](https://www.kitiquette.com/privacy?hsLang=en) explains our own handling of personal data.

## 5. Acceptable use

You will not: use the App in breach of law or HubSpot's terms; try to access other customers' data or our systems beyond the App's normal use; reverse engineer, resell or sublicense the App except as the law allows; or overload or disrupt the service.

## 6. Our responsibilities

We will provide the App with reasonable skill and care, keep it secure as described in the Data Processing Agreement, and provide support by email at [support@kitiquette.com](mailto:support@kitiquette.com) Monday to Friday, 9 am to 5 pm US Central Time, except US public holidays. We aim for, but do not guarantee, uninterrupted availability. The App depends on HubSpot and Cloudflare; their outages and changes are outside our control.

## 7. Intellectual property

We own the App and everything we provide with it. You get a non-exclusive, non-transferable right to use it for your internal business purposes during your subscription. If you send us feedback, we may use it freely.

## 8. Warranties and disclaimer

Except as stated in these Terms, the App is provided "as is". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. You are responsible for checking prices, discounts and line items before relying on them; the App's rules and discount caps are aids, not guarantees.

## 9. Limitation of liability

To the extent the law allows: neither party is liable for indirect, consequential or special damages, or for lost profits, revenue or data; and each party's total liability under these Terms is limited to the fees you paid us in the 12 months before the claim. These limits do not apply to your payment obligations, to either party's fraud or wilful misconduct, or where the law does not allow them.

## 10. Term and termination

Your subscription renews automatically for the same period unless cancelled before renewal. You can stop at any time by uninstalling the App (from its settings page or HubSpot's Connected apps) and cancelling your subscription; paid periods are not refunded unless the law requires. Either party may end these Terms if the other materially breaches them and does not fix the breach within 30 days of notice. On termination, your access ends and we delete the stored HubSpot access token. Your products, CPQ properties and line items remain in your HubSpot account.

## 11. Changes to these Terms

We may update these Terms. We will give at least 30 days' notice of material changes by email or in the App. Continuing to use the App after the change takes effect means you accept it.

## 12. General

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and the state and federal courts located in Tarrant County, Texas have exclusive jurisdiction, except where the law gives you the right to bring a claim elsewhere. Neither party may assign these Terms without consent, except to a successor of its business. If a term is unenforceable, the rest remains in effect. These Terms, with the Data Processing Agreement and the plan you chose, are the whole agreement between us about the App.
